This website is operated by Nature’s Nook Art. Throughout this website, the terms “Nature’s Nook Art,” “we,” “us,” and “our” refer to Nature’s Nook Art.
Nature’s Nook Art offers this website, including its information, products, event registrations, creative services, and other features, to you conditioned upon your acceptance of these Terms of Service and the policies referenced within them.
The terms “you” and “your” refer to the person accessing this website, making a purchase, registering for an event, booking a service, or participating in an activity provided by Nature’s Nook Art. If you make a purchase or booking on behalf of another person or organization, you represent that you are authorized to accept these Terms on their behalf.
By visiting this website, making a purchase, registering for an event, submitting a booking request, or using any part of the website, you agree to these Terms of Service. If you do not agree, you should not use the website or purchase our products or services.
SECTION 2 – ELIGIBILITY AND MINORS
You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to make a purchase, create an account, register for an event, or submit a booking through this website.
A parent, legal guardian, or other responsible adult purchasing an activity for a minor is responsible for reviewing all event information, providing accurate information, disclosing relevant allergies or health concerns, and ensuring appropriate adult supervision unless the event is specifically advertised as a supervised drop-off program.
Our website and online purchasing services are intended for adults and are not directed toward children.
SECTION 3 – WEBSITE USE
You may use this website only for lawful personal or business purposes related to learning about, purchasing, or booking Nature’s Nook Art products and services.
You agree not to:

SECTION 4 – GENERAL CONDITIONS
We reserve the right to refuse service, decline a booking, cancel an order, or limit quantities when reasonably necessary, including when:

Incorrect pricing or availability information has been displayed.

An order appears intended for unauthorized resale.

A customer or participant has engaged in threatening, abusive, unsafe, or destructive conduct.

Providing the requested product or service would create an unreasonable safety, staffing, scheduling, or operational concern.
If Nature’s Nook Art cancels a paid order, registration, or event, the customer will receive the remedy provided under our Refund Policy and applicable law.
SECTION 5 – PRODUCTS, SERVICES, AND EVENT REGISTRATIONS
Nature’s Nook Art offers creative products and services that may include public paint nights, sip-and-paint events, classes, workshops, private paint parties, children’s activities, art camps, messy play, birthday parties, fundraisers, corporate events, face painting, glitter services, art kits, take-home projects, gift cards, and custom creative services.
Products, services, classes, workshops, and event registrations may be available exclusively through this website. Availability may be limited, and registration may close when an event reaches capacity or when additional preparation time is required.
Your registration is not complete until payment has been successfully processed and you have received confirmation. Submitting an inquiry or booking request does not reserve a date, time, venue, instructor, or service unless Nature’s Nook Art provides written confirmation and any required payment has been received.
We make reasonable efforts to describe our products, services, artwork, colors, projects, and events accurately. Because artwork and creative projects are handmade, individual results will naturally vary. Colors displayed on a screen may also differ from actual paint, materials, products, or completed artwork.
Unless expressly stated otherwise, photographs are examples of the project or service and do not guarantee an identical finished result.
Prices, projects, instructors, venues, schedules, supplies, and availability may change when reasonably necessary. If we make a material change to a paid event, we will attempt to contact registered participants using the information provided during registration.
SECTION 6 – PRICES, PAYMENTS, AND BILLING INFORMATION
All prices displayed on this website are stated in United States dollars unless otherwise indicated. Applicable taxes and additional charges will be displayed during checkout or included in a written quote or invoice when required.
You agree to provide current, complete, and accurate billing, contact, and payment information. You also agree to promptly update your information when necessary.
Nature’s Nook Art is not responsible for missed confirmations, schedule changes, event information, or other communications resulting from an incorrect email address, telephone number, or other contact information provided by the customer.
We reserve the right to correct pricing, description, availability, or technical errors. If an error affects a purchase you have already made, we will contact you and provide the option required by our Refund Policy and applicable law.
Payment requirements for private parties, custom projects, corporate events, fundraisers, and contracted services may be included in a separate quote, invoice, booking confirmation, or written agreement. Those additional terms become part of the agreement between you and Nature’s Nook Art.
SECTION 7 – CANCELLATIONS, CREDITS, AND REFUNDS
Cancellations, event credits, refunds, rescheduling requests, deposits, no-shows, and final-sale items are governed by our Return and Refund Policy:

By purchasing an event registration, service, kit, project, or other product, you acknowledge that you have had an opportunity to review that policy.
When a private-event invoice, contract, quote, or booking confirmation contains additional cancellation or payment terms, those terms will also apply to that booking. If there is a direct conflict, the more specific written agreement for that private event will control to the extent permitted by law.
SECTION 8 – PRIVATE PARTIES AND CONTRACTED EVENTS
A private party or contracted event is not reserved until Nature’s Nook Art has confirmed the booking in writing and received the required deposit or payment.
The customer booking a private event is responsible for:

Providing accurate event details, including the location, date, time, anticipated attendance, and requested services.

Obtaining any required permission from the venue.

Ensuring that the venue provides reasonable access, space, lighting, tables, chairs, water, electricity, or other agreed-upon accommodations.

Communicating relevant rules and safety information to participants.
-
Ensuring that children are supervised unless the event is specifically operated as a supervised drop-off program.

Paying the balance according to the invoice or agreement.

Informing us promptly of material changes to attendance, location, schedule, or requested services.
Requests to change the date, time, location, attendance, project, or scope of an event are subject to availability and may result in additional charges.
Nature’s Nook Art is not responsible for delays, interruptions, reduced service time, or an inability to perform caused by inaccurate information, unsafe conditions, lack of venue access, missing accommodations, or circumstances controlled by the customer or venue.
SECTION 9 – EVENT PARTICIPATION AND SAFETY
Participants agree to follow reasonable instructions provided by Nature’s Nook Art staff, instructors, contractors, face painters, and event partners.
Art, craft, glitter, cosmetic, and face-painting materials may stain clothing, furniture, flooring, or personal belongings. Participants are encouraged to wear suitable clothing and protect personal property. Nature’s Nook Art is not responsible for ordinary staining, wear, or damage resulting from the expected use of these materials.
A parent, legal guardian, or responsible adult must remain responsible for a minor participant unless the event is specifically advertised and operated as a supervised drop-off program.
Nature’s Nook Art may decline or discontinue face painting, glitter application, or another service when a participant:

Appears ill or may have a contagious condition.
-
Has an open wound, rash, skin irritation, infection, or other condition that could create a health or safety concern.
-
Is unable or unwilling to participate safely.
-
Does not consent to the service.
-
Cannot remain sufficiently still for the service to be performed safely.
Participants or their responsible adults must disclose relevant allergies or sensitivities before using face paint, cosmetic glitter, adhesives, latex, art materials, or other products. Individual reactions cannot always be predicted, even when cosmetic-grade or commonly used products are selected.
Nature’s Nook Art may remove a participant whose conduct is unsafe, threatening, abusive, destructive, severely disruptive, or harmful to participants, staff, venues, or property. Removal for misconduct does not qualify for a refund or credit.
SECTION 10 – VENUES, FOOD, AND ALCOHOL
Some Nature’s Nook Art events are hosted at restaurants, breweries, museums, churches, community spaces, businesses, or other independently operated venues.
Unless expressly stated otherwise, Nature’s Nook Art does not own, operate, or control these venues and is not responsible for their food, beverages, alcohol service, accessibility, security, parking, policies, or other operations.
Food and beverages are not included with an event registration unless the event description specifically states otherwise.
When alcohol is available, it is sold and served by the host venue, not by Nature’s Nook Art. Participants must comply with all laws and venue rules concerning age identification, alcohol purchase, consumption, and conduct. Nature’s Nook Art does not provide transportation and encourages participants to make safe transportation arrangements.
SECTION 11 – ART KITS, TAKE-HOME PROJECTS, AND LOCAL PICKUP
Physical products, art kits, take-home projects, custom artwork, and workshop materials are subject to our Shipping and Pickup Policy:

Customers must wait for confirmation that an order is ready before arriving for pickup.
Unless a separate written arrangement states otherwise, purchases from Nature’s Nook Art do not include shipping or delivery.
Customers are responsible for reviewing the contents of an art kit and following included instructions. Children should use kits and supplies with age-appropriate adult supervision.
SECTION 12 – GIFT CARDS AND EVENT CREDITS
Gift cards and event credits may be used only for eligible Nature’s Nook Art products or services and are subject to any terms disclosed at purchase or issuance.
Gift cards and credits:

Are not redeemable for cash except when required by law.

May not be replaced if lost, stolen, or used without authorization, except when required by law or when Nature’s Nook Art can verify the unused balance.

May not be used to purchase another gift card unless expressly permitted.

Cannot be combined or transferred when prohibited by the terms under which they were issued.
Event credits are also governed by our Refund Policy.
SECTION 13 – INTELLECTUAL PROPERTY
The website and its content—including business names, logos, photographs, graphics, written instructions, class materials, project examples, original artwork, downloads, videos, and promotional materials—belong to Nature’s Nook Art or are used with permission.
Purchasing a class, kit, project, or event registration does not transfer ownership of our intellectual property.
Participants may ordinarily display, photograph, and share their own completed projects for personal, noncommercial use. Unless we provide written permission, you may not:

Reproduce or sell our instructional materials.

Record and distribute a class or demonstration.

Use our designs, photographs, instructions, or project materials to teach or operate a competing paid event.

Manufacture or sell products copied from protected Nature’s Nook Art materials.

Use our business name, logo, or photographs in a way that implies sponsorship, partnership, or endorsement.
SECTION 14 – CUSTOMER CONTENT, REVIEWS, AND SUBMISSIONS
If you submit a review, testimonial, comment, photograph, suggestion, or other content to Nature’s Nook Art, you represent that you have the right to provide it and that it does not violate another person’s rights.
You retain ownership of your original content. When you deliberately submit content for publication, tag Nature’s Nook Art for promotional sharing, or give us permission to use it, you grant Nature’s Nook Art a nonexclusive, royalty-free permission to reproduce, display, and share that content for the agreed purpose.
We will not knowingly use an identifiable image of a minor for advertising without permission from the minor’s parent or legal guardian.
We may remove customer content that is unlawful, threatening, abusive, deceptive, obscene, defamatory, infringing, or otherwise inappropriate.
SECTION 15 – THIRD-PARTY SERVICES AND LINKS
This website may use or link to services operated by third parties, including Shopify, payment processors, social-media platforms, mapping services, booking tools, and event venues.
We do not control third-party websites or services and are not responsible for their content, accuracy, availability, security, privacy practices, or terms. Your use of a third-party service may be governed by that provider’s separate terms and policies.
Links to third-party websites are provided for convenience and do not necessarily constitute an endorsement.
SECTION 16 – PRIVACY AND ELECTRONIC COMMUNICATIONS

SECTION 17 – ERRORS, OMISSIONS, AND AVAILABILITY
Information on this website may occasionally contain typographical errors, inaccurate descriptions, incorrect dates, pricing mistakes, or omissions.
We reserve the right to correct errors, update information, or cancel an order or registration affected by an obvious pricing or technical error. If a paid transaction is canceled, we will provide the remedy required by our Refund Policy and applicable law.
We do not guarantee that every product, project, date, service, instructor, or event shown on the website will remain available.
SECTION 18 – EVENTS BEYOND REASONABLE CONTROL
Nature’s Nook Art is not responsible for a delay, modification, relocation, interruption, or inability to perform caused by circumstances beyond our reasonable control. Such circumstances may include severe weather, dangerous travel conditions, fire, flood, utility failure, venue closure, government action, public-health emergencies, supply shortages, widespread technology failures, or the sudden illness or emergency of essential personnel when a suitable replacement is unavailable.
When these circumstances affect a paid event or order, Nature’s Nook Art will communicate available options and apply our Refund Policy, the applicable private-event agreement, and relevant law.
SECTION 19 – DISCLAIMER OF WARRANTIES
We make reasonable efforts to provide accurate information and professionally delivered products and services.
Except for warranties or rights that cannot legally be excluded, this website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, timely, or error-free.
Creative results vary according to the participant, materials, technique, age, and other circumstances. We do not guarantee that a participant’s completed artwork or project will be identical to an example, instructor sample, photograph, or another participant’s work.
Nothing in these Terms limits any warranty, right, or remedy that cannot legally be excluded under applicable law.
SECTION 20 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Nature’s Nook Art and its owners, employees, contractors, instructors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of this website or the purchase or participation in a product, service, class, workshop, or event.
Nature’s Nook Art is not responsible for:

Personal property that is lost, stolen, or left behind.

Ordinary staining or damage associated with the expected use of art, craft, glitter, or face-painting materials.

A participant’s failure to follow instructions or disclose relevant allergies or sensitivities.

The acts, omissions, products, food, beverages, alcohol service, or premises of independently operated venues.

Missed communications resulting from inaccurate contact information provided by the customer.
Nothing in this section excludes or limits liability that cannot legally be excluded or limited.
SECTION 21 – INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless Nature’s Nook Art and its owners, employees, contractors, instructors, suppliers, and service providers from third-party claims, losses, liabilities, or reasonable expenses arising from:

Your infringement of another person’s rights.

False or unauthorized content submitted by you.

We may suspend or terminate your access to the website or decline future service if you materially violate these Terms or engage in fraudulent, threatening, abusive, destructive, or unsafe conduct.
Obligations that by their nature should survive termination—including payment obligations, intellectual-property protections, limitations of liability, and dispute-related provisions—will remain effective.
SECTION 23 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law. The remaining provisions will continue in effect.
SECTION 24 – NO WAIVER
If Nature’s Nook Art does not enforce a provision of these Terms on one occasion, that does not waive our right to enforce it later.
SECTION 25 – ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Shipping and Pickup Policy, applicable product or event descriptions, and any written private-event quote, invoice, contract, or booking confirmation, constitute the agreement between you and Nature’s Nook Art concerning the applicable website use, purchase, registration, or service.
Any ambiguity in these Terms will not automatically be interpreted against either party solely because one party prepared the wording.
SECTION 26 – GOVERNING LAW
These Terms and any separate agreement through which Nature’s Nook Art provides products or services will be governed by the laws of the State of North Dakota and applicable federal law, without regard to conflict-of-law principles.
Any legal proceeding concerning these Terms or a Nature’s Nook Art transaction must be brought in a court with lawful jurisdiction over the matter.

We may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal obligations.
The current version will be posted on this page with an updated revision date. Changes apply prospectively from the date they are posted unless applicable law requires otherwise.
Your continued use of the website after an update constitutes acceptance of the revised Terms. Changes will not retroactively reduce rights or remedies already owed for a completed purchase or cancellation.
